The Legal Framework

Vietnam's Penal Code classifies cannabis alongside other narcotics with severe penalties:

  • 5 kg+ trafficking: Death penalty
  • 1.5-5 kg trafficking: 20 years to life imprisonment
  • Under 1.5 kg trafficking: 7-15 years imprisonment
  • Possession (not trafficking): 1-5 years imprisonment
  • Consumption (positive drug test): Administrative sanction or compulsory rehabilitation for 6-24 months

Drug trafficking is the most common reason for the death penalty in Vietnam. The country executes by lethal injection, and drug-related death sentences are regularly carried out.

Nightlife Enforcement

Vietnam conducts active drug enforcement in nightlife districts, particularly in:

  • Ho Chi Minh City (Saigon): Districts 1, 2, and 3, particularly Bui Vien Street and surrounding areas
  • Hanoi: The Old Quarter and Ta Hien Street area
  • Da Nang and Hoi An: Tourist nightlife areas
  • Nha Trang: Beach and bar areas popular with tourists

Police operations include entering bars and clubs unannounced and requiring patrons to submit to urine drug testing. A positive test for THC — even from use days before in another country — can result in detention, forced rehabilitation, or criminal charges depending on the circumstances.

The 2025 Reform Proposal

In April 2025, the Vietnamese Ministry of Justice proposed repealing the death penalty for 8 categories of crimes, including certain drug offenses. This proposal generated optimistic international media coverage.

However, as of March 2026:

  • The proposal has not been enacted into law
  • The National Assembly has not voted on it
  • The death penalty remains fully in effect for drug trafficking
  • Even if eventually enacted, it may not cover all drug trafficking categories

Cannabis Availability

Despite severe penalties, cannabis is available in Vietnam's tourist areas, often offered alongside other services in backpacker districts. This availability creates a false sense of security. The reality is that police conduct targeted operations in exactly these areas, and a purchase that seems casual can lead to arrest, detention, and prosecution.

  • Do not bring any cannabis to Vietnam
  • Do not purchase cannabis in nightlife or tourist areas — police operations target these locations specifically
  • Be prepared for the possibility of urine testing if you visit bars or clubs, especially late at night
  • If you have used cannabis recently, understand that a positive urine test can result in forced rehabilitation
  • Do not assume the 2025 reform proposal means the law has changed — it has not
